Will I be forced to sell Singapore home upon divorce? 
 
Q MY husband and I have been separated for nine months. He has moved out of our home, but my children and I are still living in the condominium, which is under both his name and mine.
When we divorce, what will happen to the condo? Will I be forced to sell it and split the money 50:50? What are our options if my children and I want to continue living in the condo? My husband is currently paying half of the mortgage loan.

A THE fate of your matrimonial home can be affected in two scenarios - if there is a default in the mortgage repayments and upon divorce.

If there is a default in the mortgage payments, the mortgagee bank would be entitled to recover possession of the property and sell it off.

In the event of a divorce, the division of the matrimonial home will be adjudged by the court if the parties are unable to reach an amicable settlement. When it falls to the court to decide, there are various factors that it takes into account.

The starting point is the parties’ respective direct financial contributions to the initial payments and the monthly mortgage. Payments for these through Central Provident Fund (CPF) monies are also taken into account. The court then takes into account indirect financial contributions such as renovations, payment for furniture, fittings and furnishings, monthly maintenance charges, utilities bills and other outgoings on the home.

Finally, the court takes into account indirect non-financial contributions such as looking after the children and the welfare of the family, cooking, housekeeping, looking after an aged or disabled member of the family.

In raising your children and looking after them, you would have earned an additional equity or share in the matrimonial home that would be added to your share due to your financial contributions.

The court also takes into account that if you have the care and control of your children, you would continue contributing towards their upbringing and welfare. If there was an agreement, its terms (for instance in a separation deed) would also be a factor to be considered.

However, the court does not embark on a detailed calculation of mathematical precision. Instead, it adopts a ‘broad brush’ approach and understandably so, as no one keeps such neat and precise accounts as in a business.

The court is also not compelled to order an equal division as the law requires the division to be just and equitable, although in some cases, an equal division may be the most just and equitable one.

In short, the court will be fair to both parties. Having arrived at your share or equity in the home, the next issue is to decide how to satisfy that equity, for instance whether you have the financial means and capability to buy out your husband’s share.

Depending on your age and the amount of funds available in your CPF account, you may be able to use some of those funds to buy out your husband’s share. You may also be able to find a bank willing to enter into a fresh loan agreement with you for the apartment.

If your husband is agreeable, you may also be able to postpone the sale until, say, when the youngest child reaches 21 years of age or completes his or her education, whichever occurs later.

The apartment may have to be sold as a last resort, and after deducting the outstanding loan, the refund to your respective CPF accounts and expenses of the sale, the rest of the money will then be distributed according to you and your husband’s shares as determined by the court.

While it is true that it is possible to maintain the standard of living that both parties have been used to during marriage, it is also true that upon a divorce, there will almost always be a lowering of the standard. You may have to find alternative affordable accommodation for yourself and your children and look to your husband to contribute towards the expenses as part of his monthly maintenance obligations.

With the recent amendments to the CPF Act, you may be able to persuade the courts to transfer the apartment to you without having to refund your husband’s CPF account first, but it may not be reasonable for you to insist on living in a private condo when there is ample affordable public housing available.

Top priority: Mending ties at home and across the strait  - TAIPEI

TAIPEI - TAIWAN’S President-elect Ma Ying-jeou has said that he wants to be a peacemaker.
Expectations are high that the moderate Kuomintang (KMT) politician, who advocates a pragmatic, cool-headed style of leadership, would be able to end the sometimes vicious politicking at home and also mend frayed relations abroad.

‘The responsibilities on our shoulders are enormous,’ he told his supporters after winning the presidential election by a handsome margin yesterday.

Incumbent President Chen Shui-bian of the Democratic Progressive Party (DPP) has consistently provoked China with his pro-independence moves during his eight years in office.

Mr Chen’s antagonistic style has irked not only China, but also Taiwan’s strongest ally, the United States.

During his election campaigning, Mr Ma has repeatedly stressed that the KMT ‘would be a peacemaker, not a troublemaker’.
But his first task must be to soothe the bitter rivalry between his party and the pro-independence DPP, and to heal the rift in Taiwan’s polarised society.

‘Mr Ma would have to find some way to work with the DPP. One possible way could be to rope in DPP politicians to take up positions in his Cabinet,’ said Professor Ger Yeong-kuang of the National Taiwan University.

In his victory speech, Mr Ma said that he would ‘respect the opposition party’.

He promised to incorporate into his policy blueprint some of the views raised by his DPP presidential rival Frank Hsieh, whom he spoke to on the phone after the results were out.

Another top priority for the president-elect is to mend crossstrait ties and normalise economic relations with China.

One of his election promises is to negotiate weekend charter flights between Taiwan and China by July, and open up Taiwan to mainland tourists simultaneously.

While analysts expect progress on the cross-strait economic front, they do not foresee a breakthrough in political dialogue during his four-term presidency.

Mr Ma will need to tackle the issue of Taiwan’s status with care because of his background. He was born in Hong Kong to parents who came from China.

Mr Ma, who has never visited the mainland, repeated yesterday that he has no plans to do so before his May 20 inauguration.

Apart from China, improving ties with the US wold also be high up on his agenda.

‘Mr Ma’s election is good news for Taiwan-US ties. Washington sees him as a reliable guy who would not stoke tension in the Taiwan Strait,’ said Professor Edward Chen, an expert on American studies at Tamkang University.

That could herald a more balanced US policy towards Taiwan.

Under growing pressure from Beijing to rein in Mr Chen, Washington has increasingly waved the stick at Taipei in recent years.

‘The cooling of cross-strait tension would be consistent with the interests of the US, which needs China’s cooperation on a range of global issues,’ Prof Chen told The Sunday Times.

On Taiwan’s relations with other countries, Mr Ma has pledged to pursue a ‘flexible’ diplomacy.

For instance, he has proposed that Taiwan could join international organisations under ‘flexible’ titles acceptable to Beijing.

How to plug Taiwan into the process of regional economic integration would be another major challenge for Mr Ma, who swept to power promising to revive Taiwan’s flagging economy,

He has proposed to seal a comprehensive economic cooperation agreement with China - which he hopes would pave the way for trade agreements with other countries.

He has listed as priorities sealing free trade agreements with Singapore, the US, Japan and South Korea.

SINGAPORE last night congratulated Kuomintang candidate Ma Ying-jeou on his election as President and said it looked forward to better cross-strait relations.

‘We welcome the successful conclusion of Taiwan’s presidential election on 22 March 2008 and congratulate Dr Ma Ying-jeou on his election,’ a Ministry of Foreign Affairs statement said in response to media queries.

‘As a long-standing friend of Taiwan, Singapore will continue to maintain good relations with Taiwan based on our ‘One China’ policy.’

The statement also said: ‘We look forward to better cross-strait relations. President Hu Jintao has called for negotiations with Taiwan to build up a framework for the peaceful development of cross-strait relations. Dr Ma has also pledged to promote economic interactions and dialogue across the Taiwan Strait.

‘We urge all parties to take advantage of this new opportunity to resume dialogue and work towards greater peace and prosperity in the region.’

F1 betting still slow to catch on  - Singapore

Punters cautious despite promotion efforts, but Singapore Pools says response has been good

IF YOU say ‘I bet Lewis Hamilton will win today’s Malaysian Formula One Grand Prix’, that would not be wishful thinking.
Singapore Pools flagged off legalised F1 betting on March 4 at all its outlets, and you can now put your money where your mouth is.

But when The Sunday Times visited its SportsBuzz outlet in Paradiz Centre yesterday, bettors were not exactly rushing to get into pole position to place F1 bets.

Of the 15 people interviewed there, eight had placed F1 bets.

To help get their engines going, Singapore Pools has been conducting briefings at its headquarters in Paradiz Centre.

It also provided free live screenings of the qualifying and final races of last weekend’s Australian GP. This weekend’s Malaysian GP in Sepang will be screened there too.

For football matches, a betting slip is usually needed to enter the screening venue, which has 47 projection and TV screens and space for 300 punters.

More than 50 people turned up to watch the screening of the Sepang qualifying race yesterday.

To fuel interest in F1 betting, Singapore Pools gives a 20-minute PowerPoint briefing half an hour before the races start. Punters get a quick lesson on the drivers and carmakers as well as how to place bets.

Cashier Chua Heng Guan, 54, said yesterday was the first time he had watched an F1 race.

He learnt of the free screening through an invitation he received after he placed bets for 4-D and football last week.

But he did not place any F1 bets yesterday. Those who did said they were starting out with small bets first.

Estate officer Patrick Tan, 49, a fan of the Ferrari team, said he placed smaller bets on the F1 than on football. He bets up to $100 per football match, but bets only up to $50 per F1 race.

‘I bet more on football because it’s more predictable,’ he said.

A Singapore Pools spokesman said the response to F1 betting ‘has been good’. But she did not give figures for total bets placed, citing business confidentiality.

This is the first time that legal betting for motor racing is allowed in Singapore, with 23 bet types offered.

Popular bet types include picking the driver who will qualify for the starting position for the finals and the race winner.

Bets for individual races can be placed from the Tuesday before the race, up to five minutes before the race starts.

But live betting is available at the SportsBuzz outlet where punters can place bets for selected bet types, such as the race winner and the fastest lap-time, until about 75per cent through the races.

Ma wins big as Taiwanese opt for change  - TAIPEI

TAIPEI - A TIDE of public discontent swept Taiwan’s ruling Democratic Progressive Party (DPP) from power in yesterday’s presidential election, which was won by Mr Ma Ying-jeou.
Mr Ma surged to an early lead when vote-counting started after 4pm, and his party, the Kuomintang, was already claiming victory just over two hours later.

Official results announced later showed that he had garnered 58.4 per cent of the votes compared with 41.6 per cent won by his DPP rival Frank Hsieh.

‘This is a victory for people who hope for change and openness and reform,’ Mr Ma, 57, told ecstatic supporters outside his campaign headquarters.

Despite predictions that the election could turn out to be a close race, he won more votes than any other candidate in Taiwan’s direct presidential elections.

About 76 per cent of Taiwan’s 17.3 million eligible voters turned out to cast their ballots.

Over at the DPP camp, Mr Hsieh conceded defeat in a speech to crestfallen supporters, many of them in tears.

‘It’s my defeat, not that of the Taiwanese people. Please don’t cry for me,’ said the former premier, 61. He said he would quit politics.

The defeat was another major blow for the DPP.

Having lost control of the legislature to the KMT in January, the party had campaigned hard to ‘reverse the tide’.

But analysts say voters have had enough of a DPP president whose eight years in power had been marked by controversial and provocative acts that heightened tensions with China and whose administration had done little to grow the economy and been tainted by scandal.

So they voted for change, electing a candidate known as ‘Mr Clean’ who has promised not to make trouble and instead to work to revive the economy.

Indeed, Mr Ma, a former justice minister, again stressed the importance of a clean government.

‘This is something I have learnt from Singapore. In their more than 40 years of nationbuilding, they have never for a second stopped stressing the importance of a clean government,’ he said at a post-election press conference.

The United States and Singapore last night congratulated Mr Ma on his victory.

The election is closely watched in China and the US for signs of a new approach following President Chen Shui-bian’s pro-independence antics.

Aside from Mr Ma’s victory, yesterday clearly marked a revival of political fortunes for the KMT, which lost to the DPP in 2000 and again in 2004 by a razor-thin margin. Before that, the KMT had governed Taiwan for about 50 years.

Separately, two referendums on Taiwan’s bid to join the United Nations failed to garner sufficient support yesterday.

Mr Ma will formally take office on May 20 but he is all geared up.

‘The election ends today, and the governance starts tomorrow,’ he told supporters.
